Terms of Service
This section applies to any products or services and their descriptions listed on the Canadian Chimney website, work orders, quotes, estimates, invoices and in emails - rendered.
Work Space
Canadian Chimney Service Technicians may require access to areas that may be related directly or indirectly to the rendered service. Please provide an unobstructed space greater than 4'x4' in the main working area. The space must be free of trinkets, pictures, furniture, materials that may be damaged.
Health & Safety
The health and safety of our Technician(s) is very important to us, so please provide a work environment that is free of health and safety hazards including but not limited to: slip hazards, falling objects, air pollutants, illegal drugs, toxins, biological hazards, needles, high decibel sounds, verbally or physically aggressive animals or persons. If there are potential site hazards that may pose a risk to Canadian Chimney personnel, please notify our office before the scheduled service.
Access
Before your scheduled service, please ensure that our Technician has access to the service location including the inside of dwelling. Roads, walkways, and work areas must be accessible and free of health and safety hazards.
Parking
Please provide our service vehicle an area to park that will allow for convenient loading and unloading of equipment during the scheduled appointment.
Power & Water
Many of our services require the use of electric power for tools, equipment and some services require the use of tap water to connect a hose to. If your scheduled service requires the use of these items, please ensure our Technician(s) have access during the scheduled visit.
Communications
If your service requires verbal communication, or instructions, please be available for discussion either in person or by phone throughout the duration of the service. To get the most out of our services, we recommend to book our services exclusive of other contractors, or service providers, distractions or obligations booked at the same time. Some important information such as fire safety is best discussed in person verbally.
48 Hour Policy
We require written notice (email) for any changes, modifications or cancellations for scheduled services (not including repairs). Failure to provide written notice at least 48 hours prior to the scheduled service will be subject to the full work order amount + any incurred fees, charges and surcharges.
Payment
The balance owing for products and services rendered is due while the Technician is on site (same day of scheduled service). More specific payment terms and conditions are illustrated in our estimates, job orders, service reminders, online client hub, and invoices. Our accepted payment methods are Cash, Visa, and MasterCard, we do not accept cheques. If you will not be on site for the scheduled service, please pre arrange means of payment. Services and products acquired from Canadian Chimney must comply to their applicable terms and conditions. Late payments or deviation from any of the terms and conditions will be subject to additional interest, administration fees and surcharges.
- 25% Non-refundable "deposit" payment is required to schedule any repairs. - project preparation, administration, scheduling, office fees.

Chimney Sweep Service Limitations & Terms of Service
Sweep Not Clean
A chimney sweep service is defined as a sweep rather than a "clean", as the term "clean" may suggest that the entire chimney is spotless. Our chimney sweep service sweeps the stage 1 and 2 creosote deposits from the flue. Even though we use aggressive power sweeping tools, sometimes not all the combustible deposits can be used with standard methods. For example, a tarry hard substance defined as stage 3 glazed creosote fuses to the inner chimney flue wall and can not generally be removed during a standard sweep. We offer other more aggressive means and services for specific situations (additional fees apply)
Not Included
This service will not address stage 3 glazed creosote deposits. The service does not include cleaning out the ash dump, glass, dusting, waste disposal or anything other than power sweeping the chimney flue.
No Inspection
We strongly recommend that all units be inspected (additional fees apply). The Fire Code requires all solid fuel burning appliances be inspected at least annually, after any changes or after a chimney fire. If solely a sweep service is rendered (not recommended), your unit will not be inspected for any defects or compliance. Canadian Chimney does not assume any liability for defects, non compliance, if or how the unit is used as the technician will only sweep and not inspect. Again, we strongly advise that the unit(s) be inspected at least annually.
Service pricing varies depending on location, quantity, relationship history, type of service, description limitations, calendar days, time, tax rates, and the clients conformance to our Terms of Service.
Inspection Services
Limitations, Conditions and Terms of Service
Inspections are conducted based on the level of inspection rendered, the information available during the time of the site visit, and represent the conditions until the Technician left the property. In the case of 'Problem' results, the findings represent either a measured deviance from Building Code, Fire Code, B-365, or Manufacturers Installation Requirements, or our opinion that some deviation exists. Where / if we report "OK" we cannot and do not warranty the inspected feature. Caveat emptor
Use & Liability
If no defects are reported during one of our chimney inspections, this does NOT necessarily suggest the unit is compliant, nor are we suggesting the unit is "safe to use", or "suitable for use". Heating appliances, or the nature of burning a fire in your home, comes with inherent risks, as such, we DO NOT recommend use. The decision to use a fireplace, wood burning stove, furnace, heater or other vented appliance is a personal decision that only you can make. The role of a chimney inspector is to report on compliance, educate you to the associated risks, proper use. We recommend that any areas with reported non compliance have corrective action and a new inspection conducted prior to use.
Expiry
The Fire Code requires all chimneys, flues and flue pipes be inspected at least annually, after any changes or after a chimney fire. Inspection reports represent the conditions up until the Technician left the property. Requests for a new report, another site visit, further level of inspection, a different service or repair, copy, updates, or anything else are all subject to additional fees. We provide “loyalty” discounts to our returning customers.
Line of Sight
Areas that have been marked compliant are a representation of the surfaces that are clearly visible with the naked eye. The comments do not represent any surfaces or areas that could not be observed on “all four sides”. To inspect a system to ensure absolute compliance, invasive means such as opening walls would be required (Full Level 3 Inspection).
Information
There can be a lot of unknown details about the appliance and or chimney inspected; exact date of installation, original manufacturer installation manual, manufacturer acceptable limits, AHJ perspective \ requirements, individual parts, k values of surrounding materials, persons who installed, permitting, if any modifications, alterations or renovations were made after the original installation etc. Please have any details or documents ready at the time of inspection, as only the information available during the site visit will be utilized for reporting.
Factory built appliances and equipment (metal) must have the original manufacturers manual to be able to determine installation requirements, clearances etc. If you do not have an original manual, please contact the manufacturer and request one prior to the appointment, otherwise the inspection will be conducted without this information.

Report Document
Inspection reports are emailed to the address provided when the service is \ was scheduled. The report is the original, official document and is protected as a legal document. As such, no modifications, updates, or changes can be made. Requests for a new report, site visit, a different service or repair, copy, updates, or anything else are all subject to additional fees.
Level of Inspection
The level of inspection that you render will dictate the areas that are observed. We can't see behind walls, do not have x-ray vision and may be limited to observing (line of sight) certain areas depending on your level of inspection. A level 1 inspection is a very basic inspection that is suitable for units that have received regular inspections and service from a qualified professional, the history is known and there are no known performance or compliance issues. In most circumstances, a level 2 inspection is highly recommended.

Roof Access
Limitations, Conditions, Terms of Service
Services that require access to the roof are subject to the following terms of service
Roof Pitch
A roof pitch range of 0/12 to 5/12 is included in our pricing for services that require roof access. Services on roofs with a pitch greater than 5/12 are subject to additional fees, as more time is required to install safety equipment and perform the service duties.
Weather
Bad weather limitations may include strong winds, ice, snow, rain, hail, extreme heat or cold.
Roof Height
Services that typically involve rooftop access have a standard height limitation of 20'. Roof top services are quoted with ease of access utilizing a 20' ladder. Often our technicians will use multiple ladders to access 2 story homes by setting up a ladder on a lower house level or garage rooftop. If access requires a different tool other than a 20' ladder, additional fees will apply.
Service
If the service rendered does not typically include roof-top access (sweep and \ or level 1 inspection) and you would like us to go on the roof, additional fees will apply.

Conformance
Canadian Chimney will comply with National, Provincial and local codes, standards, laws, by-laws and regulations pertaining to the products & services we offer, the manner in which we conduct business, as how we treat our employees, contractors, the general public and our clients.
Warranty
Product warranties are provided by the manufacturer and are subject to their terms and conditions. Warranties offered by Canadian Chimney are provided on an individual basis specific to the service we provide, conditions, limitations and terms.
Our limited warranty may be applicable to our repair services and qualifying products only. If your product or service qualifies for a limited warranty, the terms will be illustrated on the provided estimate, invoice or receipt. The duration of the warranty will be provided in your estimate (if any) and is limited to the following:
- Code Compliance: The Canadian Chimney Limited Warranty is provided to code compliant units only. If repairs or services have been conducted on a unit that is not code compliant, we will not assume any liability or warranty. We strongly recommend to take corrective action to conform to the applicable codes and standards.
- Maintenance: Annual chimney inspection service, and maintenance required by the Fire Code must be rendered by Canadian Chimney. Failure to obtain an annual inspection , sweeps and /or maintenance, will nullify any Canadian Chimney warranties.
- Modifications: No modification, alterations or abuse to the system. Any of these circumstances will nullify the warranty.
- Normal Use: Appliances and their equipment must be utilised as designed, and\or tested, listed for use. Any deviance such as over firing will nullify any applicable warranty.
- Natural Occurrences: Hail storms, damaging winds, house fire etc will not be warrantied by Canadian Chimney.
- Time Reported: If you have obtained a product or service with Canadian Chimney that is suspect, please contact us immediately, as time is of the essence. We do not warranty any errors or defects that have not been reported immediately.
Canadian Chimney Repair Services
Our limited repair service warranty is applicable to qualifying repairs only.
Returns, Refunds, Exchanges
Canadian Chimney has a no refund policy on all products and services, unless written approval has been provided.
Special Orders
Special orders are subject to our no return policy.
Unless otherwise noted or agreed upon, we have a No Return Policy on products that are not manufactured by Canadian Chimney. In some instances we may agree to assist our clients return the unused items to the manufacturer. These services may be subject to processing and handling surcharges.
